We currently have a Special Credit Manager position available at our Corporate Headquarters in Boise, Idaho, US.

SUMMARYThe Special Credit Manager is responsible for the management and strategic direction of special credit accounts for Simplots business units across the United States. This is not an attorney role, and the position is not part of the Legal Department. RESPONSIBILITIES Design, implement and oversee effective collection procedures in accordance with Simplots credit policy.Manage all credit accounts over 120 days. Review customers financial standing, financial statements, credit reports, and payment practices, and work directly with customer to collect assigned past due accounts and resolve credit problems in accordance with Simplots credit policy. For accounts that cannot be resolved in a timely manner, work with customer, business unit, AFSM (Area Financial Services Manager) and/or Legal Department to determine appropriate resolution (e.g., workout agreement, demand letter, judicial action, small claims, referral to a collection agency, etc.).Research, interview, engage and manage outside counsel in various states. Negotiate flat fee or results-based fee arrangements as warranted. Work with outside counsel to create Simplot forms for judicial pleadings. Review and approve all pleadings prepared by outside counsel before they are filed. Monitor and review performance of outside counsel on an annual basis and demonstrate savings to senior executives.Review and monitor all Bankruptcy filings and prepare all Proofs of Claim.Perform periodic research on all state and federal laws applicable to security and collection actions, and recent trends and practices in collections and report changes to the AFSMs and Credit Analysts.Monitor and recommend changes to existing forms, including credit applications, terms and conditions of sale, promissory notes, personal and corporate guaranties, and security agreements for various types of collateral. Maintain SharePoint Site with credit forms and resources.Prepare all security agreements, and prepare and file UCCs, EFSs, statutory lien notices, and other documents to perfect and secure Simplots lien rights.Research and monitor state statutory liens applicable to Simplot as a lienholder. Recommend legislative changes, if any, to the Legal Department.Field questions from AFSMs and Credit Analysts; elevate issues to Legal Department when necessary. Provide annual training to AFSMs and Credit Analysts on issues identified with collection matters over the prior FY.Performs other duties and projects as assigned.REQUIREMENTSBachelors Degree Required In Accounting Finance degree and a Juris Doctorate OR Any degree with an MBA and a Juris Doctorate. Minimum of 5 years applicable experience in creditors rights and bankruptcy matters. Demonstrated knowledge of the practices, processes, technology and applications associated with debt collections. Self-sufficient in drafting, filing, mailing, etc. Excellent written and oral communications skills. Ability to build relationships and work well with senior executives, employees at all levels, and customers of Simplots retail and wholesale operations; gain credibility quickly; and effectively partner with business units across the United States to meet shared objectives. Demonstrated business acumen in a commercial setting and a proactive, solutions-oriented approach to credit management. Self-starter, able to function effectively in a fast-paced environment. Ability to travel (approximately 15%).Combination of education, training and/or experience will be considered for this position.
